WAIVER AND RELEASE OF LIABILITY FORM

In consideration of being permitted to participate in the activities of Empire League Baseball LLC (referred to collectively as the ELB) in any capacity, including but not limited to, playing in league games or practices, coaching, or being on the field, in a dugout, or in a spectator area for any purpose whatsoever, and fully understanding that participation in the game of baseball includes the risk of serious personal injury, the player does fully and absolutely assume all risk of injury to themselves, including, but not limited to fatality, and do hereby unconditionally and absolutely release, even for their own negligence, indemnify and hold harmless the following: Eddie Gonzalez; Jerry Gonzalez, Matt Joyce and Eddie Gonzalez Jr; any other members, officers, volunteers, game officials, or persons affiliated with ELB; all landowners of facilities that may sanction, or give permission for use of facility for play or practice; any governmental agencies involved with Empire League Baseball or the facilities at which games or practices may take place; any organizations involved in the sponsorship of teams competing within Empire League Baseball; from all claims for damage or injuries of any kind, now or in the future.

Furthermore I am physically fit to participate in the daily program activities. I hereby authorize the staff of the Empire League Baseball to act for me in an emergency.

I agree to abide by and obey any and all League Rules as set forth by Empire League Baseball, and fully agree to accept any suspensions or disciplinary actions that shall be handed down by Empire League Baseball officials pursuant to any behavior on my part that may, at the Empire League Baseball’s sole discretion, warrant such action by ELB.

I further grant Empire League Baseball and/or its agents the use of my likeness in any photographs, video recording, motion pictures or other records of the event for any reasonable purpose without compensation therefore.

I HAVE READ THIS WAIVER AND RELEASE OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY AGREEING TO IT, AND HAVE AGREED TO IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME AND INTEND MY AGREEMENT TO BE COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.

NO REFUND POLICY

Your registration is a firm commitment to participate in the current ELB Spring Training and Pro Baseball Showcase camp. By clicking submit, the submitting player and/or third party paying for the player agrees that no refunds will be issued for any reason. All fees paid are to cover in advance the costs in which the player has paid for during the ELB Spring Training and Pro Baseball Showcase camp. This registration and process of payment does not guarantee one player roster spot within the Empire League Baseball season, which has limited space. The ELB will not grant refunds of any kind, regardless of the player’s feelings of their own performance, quitting, signing up for another league, injury, weather, acts of God, Federal, State, or local government actions, the third party instructors’ evaluations, or the player’s personal opinion of the ELB. This payment is specifically for the opportunity to participate in the  ELB Spring Training and Pro Baseball Showcase camp and does not guarantee, represent the player a contract with any team or league at the completion of the ELB. If a player is unable to attend you will be provided credit for the following year.
